What is an "information agency"?

An information agency is a subject of information activity registered as a legal entity, acting for the purpose of providing information services.

Information agencies are engaged in the production and distribution of their own products for the purpose of making a profit.

Information agencies have no right to promote communist and/or national socialist (nazi) totalitarian regimes and their symbols in their materials.

Information agencies can distribute their products both in Ukrainian and in other languages.

Who can create an information agency?

The following have the right to establish an information agency:

citizens and legal entities of Ukraine;

foreigners and foreign legal entities, provided that they are only co-founders of the information agency.

It is prohibited to create and operate information agencies, in the statutory fund of which the aggregate share belonging to foreigners and/or foreign legal entities is more than 35 percent.

What needs to be decided before registering an information agency?

1. The name and abbreviated name of the information agency in the languages ​​in which it will be published;

2. Type of information agency:

  • state,
  • non-state,
  • representation of a foreign information agency;

3. Organizational and legal form of the information agency, for example: public organization or union, limited liability company, etc.;

4. Intended area of ​​distribution of information products:

  • local - within the ARC, one oblast, regional center or two or more rural districts, one city, district, individual settlements, as well as enterprises, institutions, organizations,
  • regional - two or more oblasts, cities of Kyiv or Sevastopol and oblast, ARC and oblast,
  • national - within Ukraine,
  • national and foreign - within Ukraine and beyond,
  • foreign - outside Ukraine;

5. Language/languages ​​in which information products will be distributed:

  • monolingual,
  • in several languages ​​at the same time (parallel releases),
  • in mixed languages ​​(several languages);

6. Program goal and main areas of activity of the information agency;

7. Sources of financial and logistical support for the activities of the information agency;

8. Location of the information agency.

What is a "representation of an information agency"?

Representation of an information agency in Ukraine is an institution registered in Ukraine as a subject of information activity (bureau, representative office, headquarters, etc.), which represents a state or non-state information agency in Ukraine, registered as a legal entity, in accordance with the current legislation of a certain of the country, and which carries out its activities in Ukraine in the field of information in accordance with the Law "On Information" and the Law "On Information Agencies".

Is it possible to register an information agency as an individual entrepreneur?

No you can not. The information agency is registered exclusively on the basis of a legal entity. That is, to register an information agency, you must be a registered legal entity.

The founders of the information agency will be persons who are the founders of the legal entity on the basis of which the agency will be registered.
